Terms and conditions of sale
The present Terms & Conditions are entered into on the one hand by Sous l’Ocean Travel Private Limited whose registered office is at : Ibrahimee Aabaadhu 5th Floor, Majeedhee Magu, Maafannu, 20325 Male', Maldives, registered in the Trade and Companies Register of the Maldives under number C-0444/2012 hereinafter referred to as " Sous l’Ocean Travel " and, on the other hand, by any individual or legal entity wishing to make a purchase via the www.soulocean.com website, hereinafter referred to as "the buyer".
The purpose of these general terms and conditions of sale is to define the contractual relationship between Sous l’Ocean Travel and the purchaser, and the conditions applicable to all purchases made through the Sous l’Ocean Travel merchant site, whether the purchaser is a professional or a consumer. The acquisition of a good or service through this site implies unreserved acceptance by the buyer of these general conditions of sale. These Terms & Conditions shall prevail over any other general or special conditions not expressly approved by Sous l’Ocean Travel. Sous l'Océan Travel reserves the right to modify Terms & Conditions at any time. In this case, the applicable conditions will be those in force at the date of the buyer's order.
CHARACTERISTICS OF THE GOODS AND SERVICES OFFERED
The products and services offered are those shown on the Sous l’Ocean Travel website. These products and services are offered while stocks last. Each product is accompanied by a description drawn up by the supplier. The photographs on the website are as accurate as possible, but cannot guarantee a perfect similarity with the product offered. Minor variations may appear between the photos on the description sheets and the products supplied.
The prices communicated at the time of registration have been calculated on the basis of air fares, exchange rates and taxes known at the date of publication of the travel proposal. These prices will be adjusted in the event of variations in any of these factors. In the event of a change in these conditions, we reserve the right to modify the selling price with at least 30 days' notice prior to the departure date. The customer will be provided with a supporting statement, and if the increase exceeds 10%, he/she will have the option of cancelling without charge. Published prices are not binding. An invoice and an estimate will be given to the traveler, mentioning the services provided and constituting a contract between Sous l’Ocean Travel and the traveler. Prices do not include the cost of passports, visas, vaccination certificates, exceptional expenses resulting from fortuitous events (strikes, weather conditions), or cancellation insurance.
Purchasers wishing to purchase a product or service must: complete the registration form, giving all the contact details requested; accept the general terms and conditions of sale; accept the booking and cancellation conditions specific to each service; confirm their order after checking it; make payment as stipulated. Confirmation of the order after the first payment, if applicable, implies acceptance of the present Terms & Conditions, acknowledgement of full knowledge thereof and waiver of the right to invoke one's own conditions of purchase or other conditions. All data supplied and the recorded confirmation shall constitute proof of the transaction. Confirmation shall constitute signature and acceptance of the operations carried out. The seller will send confirmation of the registered order by e-mail.
Payments must be made as follows: 30% of the total amount upon registration, the balance of the service price must be received at Sous l’Ocean Travel 60 days before departure. Registrations received less than 60 days before departure must be paid in full. If payment is not made on time, Sous l’Ocean Travel may refuse the trip and charge cancellation fees. We reserve the right to cancel a departure without a sufficient number of participants, or to substitute one boat for another. Our prices are based on a number of nights (not days).
MODIFICATION AND CANCELLATION
Any modification or cancellation of a trip after registration must be notified to us by email. The date of receipt of the email will determine the date of cancellation. Cancellation, whatever the date, does not exempt you from paying the full amount due. The refund procedure can only take place under this condition. In the event of a request to modify the booking, we will do our best to find an appropriate alternative with you, subject to availability.
In the event of cancellation or modification by the purchaser, reimbursement will be made after deduction of the cancellation charges indicated in the booking and cancellation conditions specific to each service.
MODIFICATION AND CANCELLATION BY THE ORGANIZER
Sous l’Ocean Travel reserves the right to modify, interrupt or cancel a trip due to circumstances beyond its control or for reasons relating to the interest or safety of travelers. These cases of force majeure include but are not limited to: refusal or cancellation of landing rights, strikes, civil or international war, political or economic unrest, terrorist attacks, fires, climatic, maritime, seismic or volcanic events. In such cases, you will be informed as quickly as possible. In such cases, participants will not be entitled to any compensation.
SPECIAL CONDITIONS FOR CROISES AND SAFARIS
In the event of technical damage, or any other case of force majeure beyond our control, preventing the boat from departing on the scheduled date, and if no other replacement boat can be found, we will offer you the possibility of postponing your trip, free of charge, to a later date.
The minimum number of participants is six to guarantee the departure of cruises, unless otherwise specified in the booking and cancellation conditions specific to each service. If the minimum number of participants is not reached, Sous l’Ocean Travel may cancel the trip up to eight days before departure. In this case, we will naturally do our utmost to offer you a replacement program of the same value. If this is not possible, or if you refuse, Sous l’Ocean Travel will reimburse you in full for any payments already made. Any claim to further compensation is excluded.
Cruise itineraries and programs are given in the trip descriptions for information only. Any changes to itineraries and programs due to weather conditions, changes in the conditions for observing marine fauna or filling problems will not entitle you to claim damages.
À LA CARTE SERVICES OUTSIDE THE PACKAGE TRAVEL
If, due to a change in the program of our services (plane schedule, delay in ground transport or other), you should miss all or part of the services that you would have booked by your own means, we cannot be held responsible, and no compensation can be granted.
COMPLAINTS - AFTER-SALES SERVICE
If you find that a service does not correspond to the contract, please contact our local representative as soon as possible to avoid any consequences for the rest of your trip. We ask our customers who have any comments to make about their trip to send them to us as soon as they return, so that we can take action with the suppliers concerned. Any request for reimbursement of additional services or services invoiced but not provided will be considered on presentation of the corresponding receipts.
The present Terms & Conditions are subject to Maldivian law. The place of jurisdiction for all disputes is Male, Maldives.
