General terms and conditions of sale

The present Terms & Conditions are concluded on the one hand by the company Sous l’Ocean Travel Private Limited whose registered office is at : Ibrahimee Aabaadhu 5th Floor, Majeedhee Magu, Maafannu, 20325 Male', Maldives, registered in the Trade and Companies Register of Maldives under number C-0444/2012 hereinafter referred to as " Sous l’Ocean Travel " and on the other hand, by any individual or legal entity wishing to make a purchase via the website, hereinafter referred to as "the buyer".

The present general conditions of sale aim at defining the contractual relations between Sous l’Ocean Travel and the purchaser and the conditions applicable to any purchase carried out by the means of the commercial site of Sous l’Ocean Travel, that the purchaser is professional or consumer. The acquisition of a good or a service through the present site implies an acceptance without reserve by the buyer of the present general conditions of sale. These Terms & Conditions will prevail over any other general or particular conditions not expressly approved by Sous l’Ocean Travel. Sous l'Océan Travel reserves the right to modify its Terms & Conditions at any time. In this case, the applicable conditions will be those in force at the date of the order by the buyer.

The products and services offered are those listed on the Sous l’Ocean Travel website. These products and services are offered within the limits of available stocks. Each product is accompanied by a description established by the supplier. The photographs on the website are as accurate as possible but cannot ensure a perfect similarity with the product offered, minimal variations may appear between the photos on the description sheets and the products provided.

The prices communicated at the time of registration have been calculated on the basis of airfares, exchange rates and taxes known at the date of the travel proposal. These prices will be adjusted in case of variation of one of these elements. In the event of a change in these conditions, we reserve the right to modify the selling price with a minimum of 30 days notice in relation to the departure date. The customer will be given a statement of the reasons for the change and if the increase exceeds 10%, he will have the right to cancel without any charge. The published prices are not binding. An invoice and an estimate will be given to the traveler mentioning the services provided and valid contract between Sous l’Ocean Travel and the traveler. The price does not include the cost of passports, visas, vaccination certificates, exceptional expenses resulting from fortuitous events (strikes, weather conditions), cancellation insurance.

The buyer, who wishes to buy a product or a service, must obligatorily: fill in the registration form on which he will indicate all the requested details; accept the general conditions of sale; accept the conditions of reservation and cancellation specific to each service; validate his order after having checked it; make the payment under the conditions provided. The confirmation of the order after the first payment, if any, implies acceptance of these Terms & Conditions, the recognition of having full knowledge and waiver of its own conditions of purchase or other conditions. All the data provided and the recorded confirmation will be worth proof of the transaction. The confirmation will be worth signature and acceptance of the operations carried out. The seller will communicate by e-mail confirmation of the registered order.
Payments must be made as follows: 30% of the total amount at registration, the balance of the price of the service must reach Sous l’Ocean Travel 60 days before departure. Any registration less than 60 days before departure must be paid in full. If the payment is not made in time, Sous l’Ocean Travel can refuse the services of the trip and charge cancellation fees. We reserve the right to cancel a departure without a sufficient number of participants, or to substitute one boat for another. Our prices are calculated on a number of nights (not days).

Any modification or cancellation of a trip after registration must be notified to us by email. The date of receipt of the email will determine the date of cancellation. The cancellation, whatever its date, does not exempt from the full payment of the sums due. The refund procedure can only take place under this condition. In the case of a request for modification of the reservation, we will do our best to find with you an appropriate alternative according to availability.
In case of cancellation or modification by the buyer, the refund of the sums will intervene after deduction of the cancellation fees indicated in the conditions of reservation and cancellation specific to each service.

Sous l’Ocean Travel reserves the right to modify, interrupt or cancel a trip due to circumstances of force majeure or for reasons relating to the interest or safety of travelers. These cases of force majeure include but are not limited to: refusal or cancellation of landing rights, strike, civil or international war, political or economic unrest, attack, fire, climatic, maritime, seismic or volcanic events. In this case, you will be informed as soon as possible. In these cases, participants will not be entitled to any compensation.

In the event of technical damage or any other case of force majeure beyond our control, which prevents the boat from departing on the scheduled date, and if no other replacement boat can be found, we will offer to postpone your trip, free of charge, to a later date.
The minimum number of participants is six to guarantee the departure of the cruises, except where otherwise stated in the reservation and cancellation conditions specific to each service. If the minimum number of participants is not reached, Sous l’Ocean Travel can cancel the trip up to eight days before departure. In this case, we will of course try to offer you a replacement program of equal value. If this is not possible or if you refuse it, Sous l’Ocean Travel will reimburse you in full the payments already made. Any claim to other compensation is excluded.
The itineraries and programs of the cruises are given as an indication in the descriptions of the trips. All modifications of the itineraries and programs following weather conditions, changes in the conditions of observation of the marine fauna or problems of filling will not be able to claim damages.

If, due to a change in the program of our service (plane schedule, delay in ground transportation or other), you should miss all or part of the services you would have booked by your own means, we could not be considered as responsible, and no compensation could be granted.

When you notice that a service does not correspond to the contract, and in order not to suffer the consequences for the continuation of your trip, please contact our local representative as soon as possible. We ask our clients who have observations to make about the course of their trip to send them to us as soon as they return so that we can intervene with the suppliers concerned. Any request for reimbursement of additional services or invoiced services not provided will be considered upon presentation of the corresponding receipts.
The present Terms & Conditions are subject to the law of the Maldives. The place of jurisdiction for all disputes is Malé, Maldives.
